Airbnb rules in NYC

Unfortunately, it is illegal in New York to rent a privately owned apartment for a short term. On Airbnb and other short-term rental platforms, hosts need to be officially registered with the city, and short-term rentals are only permitted if you are staying in the same unit or apartment as your host, with no more than two paying guests at a time. So renting an entire apartment or home for less than 30 days is not allowed.

So when you book an entire apartment via for example Airbnb, know that this is often illegal. There’s no risk of getting a fine if you book an apartment like that, but chances are that the host gets ‘caught’ and your booking will be cancelled. If this happens shortly before your trip, it might be difficult to still find a (decently priced) hotel room.

I’ve also heard a lot of complaints about people being scammed. The apartment wasn’t as the pictures described it to be, or it didn’t even exist at all. Renting an apartment in New York also isn’t cheaper than booking a hotel room. The apartment itself might seem relatively cheap, but you often have to pay extra fees (like a cleaning and service fee) that can still make your stay rather pricey. Therefore I think you are better off staying in a hotel in New York or in a company-owned apartment booked via a hotel booking website, like the selection above.

You can also divert to New Jersey, where a short-term rental is also legal. Although I don’t recommend staying across the Hudson because of the more complicated transportation to Manhattan. Booking a hotel in Long Island City would be a better option, which is also budget-friendly.”

Airbnb is illegal in New York if you are staying somewhere for less than 30 days without your host's presence. You can book an Airbnb apartment if the host is also staying there, or if you are booking for 30 days or more. In my opinion, it's better to book a hotel apartment.
